Mourland Massage Therapy Services

These Terms & Conditions (“Terms”) govern the use of services provided by Mourland Massage Therapy Services,” (“we,” “us,” “the company” or “our”) to any client (“Client,” “you,” or “your”) who books, receives, or pays for any mobile massage or wellness-related service provided by us.

By booking an appointment, purchasing a service, using our website or booking platform, or receiving any service from us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Company Services

We provide mobile massage and wellness services, meaning our licensed and/or certified massage therapists travel to a client’s location to perform services such as, but not limited to:

  • Swedish massage

  • Deep tissue massage

  • Thai Massage

  • Lomi Lomi Massage

  • Trigger Point Massage

  • Chair massage

  • Stretching or recovery services

  • Add-on wellness services, where legally permitted

All services are subject to:

  • therapist availability

  • geographic service area

  • client eligibility

  • safety considerations

  • legal/regulatory restrictions

  • therapist professional judgment

We reserve the right to decline or discontinue service at any time for safety, health, legal, or professional reasons.

2. Eligibility for Services

By booking or receiving services, you represent and warrant that:

  • You are at least 18 years old

  • All information you provide is true, complete, and accurate.

  • You will disclose all relevant medical conditions, injuries, allergies, pregnancy status, medications, and contraindications before your appointment.

  • You understand that massage therapy may not be appropriate for all individuals or conditions.

3. Not Medical Care

Our services are intended for general wellness, stress reduction, relaxation, and muscular relief unless otherwise stated. Our therapists do not diagnose illness, disease, or injury, and our services are not a substitute for medical care, physical therapy, chiropractic care, psychotherapy, or other licensed healthcare services unless specifically authorized by law and the provider’s credentials.

You should consult with a physician or other qualified healthcare provider before receiving massage if you:

  • are pregnant

  • have a cardiovascular condition

  • have a blood clotting disorder

  • have cancer

  • have a skin infection or contagious condition

  • have recent surgery

  • have fractures, severe osteoporosis, or acute injuries

  • have any condition for which massage may be contraindicated

You agree that you are solely responsible for obtaining medical clearance when appropriate.

4. Health Disclosure and Client Responsibility

Prior to each appointment, you agree to disclose any relevant health information, including but not limited to:

  • injuries or pain

  • surgeries

  • chronic conditions

  • medications

  • allergies or sensitivities

  • recent illness

  • fever or contagious symptoms

  • pregnancy

  • implanted medical devices

  • skin conditions

Failure to provide complete and accurate health information may increase risk and may result in refusal of service. We are not responsible for injuries, reactions, or complications resulting from undisclosed conditions or inaccurate information provided by you.

5. Scope of Massage Therapy; Professional Boundaries

Our services are strictly professional therapeutic massage and wellness services.

The following are strictly prohibited:

  • any sexual or erotic conduct, request, suggestion, or expectation

  • inappropriate touching

  • sexually suggestive comments or behavior

  • harassment, intimidation, or discriminatory conduct

  • solicitation of illegal services

  • being nude beyond lawful and professional draping standards

  • photographing or recording the therapist without prior written consent

Any inappropriate behavior will result in:

  • immediate termination of the session

  • full payment being due

  • refusal of future services

  • possible reporting to law enforcement, building security, or appropriate authorities

Therapists maintain the right to refuse any request that is outside their scope of practice, training, licensure, or comfort.

6. Booking and Appointments

Appointments may be booked through:

  • our website

  • a mobile app or booking platform

  • phone

  • text

  • email

  • approved third-party scheduling systems

A booking is not final until confirmed by us.

We reserve the right to:

  • accept or reject any booking request

  • limit appointments in certain areas or time windows

  • require advance booking minimums

  • require a deposit or full prepayment

  • verify your identity

  • request additional intake or consent information before confirming an appointment

7. Service Area and Travel

We provide services only within designated geographic areas. Travel fees, parking charges, tolls, access fees, resort fees, or after-hours fees may apply.

You are responsible for ensuring the service location is:

  • safe

  • clean

  • accessible

  • appropriate for professional massage services

  • free from illegal activity

  • reasonably quiet and private

  • large enough to accommodate the massage table and therapist movement

If the therapist arrives and determines the environment is unsafe, unsanitary, or otherwise unsuitable, the appointment may be canceled or terminated and the full session fee may still apply.

 

Additional charges may apply for:

  • excessive stairs without elevator access

  • extended setup difficulty

  • remote locations

  • special event services

  • hotel, office, or venue coordination

  • parking or valet expenses

8. Client Preparation and Location Requirements

You agree to:

  • provide accurate address and entry instructions

  • ensure timely access to the location

  • secure pets or animals unless they are service animals

  • ensure minors are supervised

  • ensure a sober, safe, and respectful environment

  • provide a smoke-free and hazard-free space during the service

  • notify us of any building restrictions, gate codes, parking limits, or security procedures

We reserve the right to decline service if:

  • the location is unsafe

  • there is threatening or disruptive behavior

  • illegal substances are present

  • excessive intoxication is observed

  • the therapist believes personal safety is at risk

  • the environment is not appropriate for massage services

9. Session Length and Timing

Session lengths are approximate and may include:

  • consultation

  • setup and breakdown

  • intake review

  • dressing and undressing time

  • hands-on service time

Unless otherwise specified in writing, advertised session times may refer to total appointment windows rather than guaranteed hands-on minutes.

Late starts caused by the client may reduce hands-on time without reducing the fee. If the therapist is delayed, reasonable efforts will be made to provide the full session time or otherwise adjust pricing as appropriate.

10. Fees and Payment

You agree to pay all fees associated with your booking, including:

  • service fees

  • travel fees

  • add-on charges

  • gratuity, if applicable

  • parking/toll/venue fees, where applicable

  • taxes, if applicable

  • cancellation or no-show fees

  • wait-time charges, if applicable

Payment methods accepted may include:

  • credit card

  • debit card

  • mobile payment platforms

  • cash, where permitted

  • gift certificate or prepaid voucher

  • approved third-party payment processors

We may require a valid card on file to secure an appointment.

If your payment is declined or reversed, we may:

  • charge an alternate payment method

  • suspend future bookings

  • require prepayment for future appointments

  • pursue collection of unpaid balances to the extent permitted by law

You are responsible for all costs associated with collecting unpaid amounts, including reasonable administrative, collection, and legal fees where permitted.

11. Deposits and Prepaid Appointments

We may require a non-refundable or partially refundable deposit to reserve your appointment. Deposit terms will be disclosed at the time of booking.

Unless otherwise stated:

  • deposits may be applied to the total cost of the appointment

  • deposits may be forfeited for late cancellations or no-shows

  • prepaid packages are subject to the package terms and expiration dates disclosed at purchase

12. Cancellation, Rescheduling, and No-Show Policy

We value our therapists’ time and travel commitments. Unless otherwise stated in writing, the following policy applies:

Standard Cancellation Policy

  • Cancellations made within the required notice period will be eligible for a full refund of the scheduling deposit or rescheduling at no additional cost.

  • Cancellations made within 48 hours or on the day of the appointment may be charged 100% of the full scheduling deposit.

  • No-shows may be charged 100% of the full scheduling deposit.

No-Show

A “no-show” includes, but is not limited to:

  • not being present at the agreed location

  • failing to answer calls or messages

  • providing an inaccessible location

  • delaying entry such that the session cannot reasonably proceed

  • being unable or unwilling to begin within [15] minutes of the scheduled start time

Therapist Wait Time

Therapists may wait up to 10 minutes after the scheduled start time. Additional wait time may be charged, and service time may be shortened accordingly.

Emergency Exceptions

We may, at our sole discretion, waive cancellation fees for genuine emergencies, severe weather, illness, or other extenuating circumstances. Waivers are not guaranteed.

13. Illness, Infection Control, and Refusal of Service

For the safety of clients and therapists, you must reschedule your appointment if you or anyone present at the location has:

  • fever

  • vomiting or diarrhea

  • flu-like symptoms

  • contagious skin condition

  • active infection

  • known contagious illness

  • exposure requiring isolation or quarantine under applicable public health guidance

We reserve the right to refuse or terminate service if the client appears ill, contagious, or medically unsuitable for massage at the time of the appointment. If we cancel due to therapist illness, emergency, or safety concerns, our liability is limited to rescheduling the appointment or refunding amounts paid for the canceled service.

14. Therapist Discretion and Right to Refuse Service

Our therapists may refuse or discontinue services for any lawful reason, including but not limited to:

  • undisclosed medical contraindications

  • unsafe or unsanitary conditions

  • intoxication or impairment

  • harassment or inappropriate conduct

  • aggressive or threatening behavior

  • presence of weapons

  • concerns about human trafficking, exploitation, or illegal activity

  • inability to obtain informed consent

  • requests outside the therapist’s professional scope

If a session is terminated for client misconduct or policy violations, no refund will be issued.

15. Results Disclaimer

Massage and wellness services may produce different results for different individuals. We do not guarantee:

  • pain relief

  • injury recovery

  • improved athletic performance

  • stress reduction

  • medical outcomes

  • any specific result or benefit

Responses to treatment vary based on many factors, including health status, consistency, hydration, stress, and underlying medical conditions.

16. Consent to Treatment

By receiving services, you voluntarily consent to massage therapy and understand that:

  • massage involves touch and manipulation of soft tissue

  • techniques may include pressure of varying intensity

  • mild soreness, tenderness, emotional release, or temporary fatigue may occur

  • you may ask the therapist to adjust pressure or stop treatment at any time

  • you are responsible for communicating discomfort, pain, or any concern immediately

Your consent may be withdrawn at any time, but you remain responsible for payment for services rendered and any applicable cancellation or termination fees.

17. Draping, Privacy, and Professional Conduct

Appropriate draping will be used at all times in accordance with professional standards and applicable law. Only the area being worked on will be undraped.

Clients are expected to maintain appropriate boundaries and professional conduct throughout the session.

You may request accommodations related to modesty, positioning, pressure, or communication preferences; however, accommodations are subject to therapist discretion, safety, and feasibility.

18. Intoxication, Substance Use, and Weapons

Services will not be provided if the client or others present appear to be under the influence of:

  • alcohol

  • illegal drugs

  • misused prescription drugs

  • any substance impairing judgment or safety

No weapons may be displayed or handled during an appointment. If a therapist feels unsafe for any reason, the session may be canceled or terminated immediately, with full payment due where permitted.

19. Personal Property

We are not responsible for loss, theft, or damage to personal property at the service location, except to the extent caused by our proven gross negligence or willful misconduct.

You are responsible for securing valuables, fragile items, and pets before the appointment.

20. Damage to Company Property

You are responsible for damage to Company equipment or supplies caused by:

  • misuse

  • intentional acts

  • unsafe conditions

  • pets

  • children

  • substances or spills

  • failure to provide adequate space or setup conditions

We may charge you for the repair or replacement cost of damaged equipment.

21. Gift Cards, Packages, Memberships, and Promotions

Gift Cards

  • Gift cards are non-refundable except where required by law.

  • Lost or stolen gift cards may not be replaced unless proof of purchase is provided.

  • Gift cards cannot be redeemed for cash except where required by law.

  • Expiration dates and fees, if any, will comply with applicable law.

Service Packages

  • Packages are non-transferable unless expressly stated otherwise.

  • Packages may expire on [date/term].

  • Unused sessions are forfeited after expiration unless required otherwise by law.

  • Package sessions may be subject to the same cancellation policy as single sessions.

Memberships

  • Membership billing cycles, renewal terms, freezes, and cancellation procedures will be disclosed separately.

  • Unused member benefits may not roll over unless expressly stated.

Promotions

  • Promotions cannot be combined unless explicitly allowed.

  • We may modify or withdraw promotions at any time.

  • Discounts have no cash value.

22. Refund Policy

Unless required by law, all completed services are non-refundable.

Refunds, credits, or rebookings may be considered at our sole discretion in limited circumstances, such as:

  • therapist no-show

  • duplicate charge

  • billing error

  • verified issue with service quality reported promptly

Dissatisfaction based on preference, expected outcome, or subjective experience does not automatically entitle you to a refund. Any request for refund or service issue review must be submitted within 3 days of the appointment.

We will make reasonable efforts to review complaints in good faith. Submission of a complaint does not guarantee a refund or any particular resolution.

24. Privacy and Personal Information

We may collect personal information necessary to provide services, including:

  • name

  • contact information

  • address

  • payment information

  • health or intake information

  • appointment history

  • preferences and notes relevant to service delivery

We use this information to:

  • schedule and provide services

  • communicate with you

  • process payment

  • maintain internal records

  • comply with legal obligations

  • improve operations and customer experience

We will use reasonable safeguards to protect personal information, but no system can be guaranteed 100% secure.

We will not sell your personal information except as permitted by law or disclosed in our Privacy Policy. We may share information with:

  • payment processors

  • booking software providers

  • insurance carriers

  • legal or regulatory authorities when required

  • professional advisors or service providers assisting our operations

25. Electronic Communications and Consent

By providing your contact information, you consent to receive communications from us, including:

  • appointment confirmations

  • reminders

  • follow-up messages

  • billing notifications

  • service-related announcements

  • promotional emails or texts, if you opt in

Message and data rates may apply. You may opt out of promotional communications at any time, but we may still send non-promotional service-related messages.

26. Photos, Videos, and Recordings

Clients may not photograph, audio record, or video record therapists or sessions without prior written consent.

We will not use your name, likeness, testimonial, review, or photos for marketing without your permission, except as otherwise permitted by law or platform review systems.

If you agree to provide testimonials or media content, you grant us a non-exclusive, royalty-free license to use that content for marketing and promotional purposes unless otherwise agreed in writing.

27. Website, Online Booking, and Intellectual Property

All content on our website, social media, booking pages, and materials, including text, logos, branding, graphics, photos, service descriptions, and policies, is owned by or licensed to the Company and protected by applicable intellectual property laws.

You may not:

  • reproduce

  • copy

  • distribute

  • modify

  • republish

  • sell

  • exploit

any content without our prior written consent. Use of our online systems for fraudulent, abusive, unlawful, or unauthorized purposes is prohibited.

28. Third-Party Platforms

We may use third-party platforms for:

  • scheduling

  • payment processing

  • marketing

  • customer communications

  • gift card or package management

We are not responsible for outages, security breaches, terms, or policies of third-party platforms, though we make reasonable efforts to select reputable providers.

Your use of such platforms may also be subject to their separate terms and privacy policies.

29. Limitation of Liability

To the fullest extent permitted by law, Mourland Massage Therapy Services, its owners, officers, employees, contractors, therapists, agents, affiliates, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • booking or receiving services

  • cancellation or unavailability

  • allergic reaction or sensitivity

  • aggravation of undisclosed conditions

  • dissatisfaction with results

  • delays, travel issues, or scheduling conflicts

  • website or payment platform issues

  • loss of data or communications failure

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services shall not exceed the amount actually paid by you for the specific service giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

30. Assumption of Risk

You understand and acknowledge that massage therapy and wellness services involve inherent risks, including but not limited to:

  • soreness

  • bruising

  • inflammation

  • aggravation of pre-existing conditions

  • allergic or skin reactions

  • dizziness or fatigue

  • emotional response

By receiving services, you knowingly and voluntarily assume these risks except to the extent caused by our gross negligence or willful misconduct.

31. Indemnification

You agree to defend, indemnify, and hold harmless Mourland Massage Therapy Services and its owners, employees, contractors, therapists, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your breach of these Terms

  • your inaccurate disclosures

  • unsafe conditions at the service location

  • your misconduct or the misconduct of anyone present at the location

  • damage caused by pets, guests, or invitees

  • your violation of applicable law

32. Independent Contractors

If applicable, our therapists may be employees or independent contractors. Regardless of classification, all therapists providing services through the Company are expected to comply with our professional standards, policies, and applicable law.

33. Force Majeure

We are not liable for delays, interruptions, or cancellations caused by circumstances beyond our reasonable control, including but not limited to:

  • severe weather

  • natural disasters

  • traffic accidents

  • public health emergencies

  • government actions

  • power outages

  • labor disputes

  • platform outages

  • acts of God

  • civil unrest

  • terrorism

In such cases, we may reschedule, issue a credit, or provide a refund at our discretion and as required by law.

34. Non-Discrimination

We strive to provide services in a respectful and inclusive manner. We do not discriminate on the basis of any protected characteristic as prohibited by law.

We also reserve the right to refuse service to any person for lawful, non-discriminatory reasons including safety, scope-of-practice issues, inappropriate conduct, or violation of these Terms.

35. Accessibility and Accommodation

Clients may request reasonable accommodations related to disability, communication, positioning, or access. We will make reasonable efforts to accommodate requests where feasible, safe, and lawful.

Certain limitations may apply due to the mobile nature of our services, building constraints, therapist training, or equipment limitations.

36. Mandatory Reporting and Legal Compliance

We reserve the right to report suspected abuse, exploitation, trafficking, threats, illegal conduct, or safety concerns to law enforcement, social services, building management, or other appropriate authorities where permitted or required by law.

We may also refuse or terminate service to comply with legal, licensing, or regulatory obligations.

37. Dispute Resolution

Any dispute arising out of or relating to these Terms or our services shall first be addressed through good-faith informal negotiation. You agree to contact us and attempt to resolve the matter before initiating formal legal action.

If informal resolution fails, disputes shall be resolved by:

  • small claims court

  • in Santee, CA

  • under the laws of California, USA

38. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

39. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

40. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of any right or provision.

41. Entire Agreement

These Terms, together with any intake forms, consent forms, privacy policy, booking policies, package terms, membership terms, and written service confirmations, constitute the entire agreement between you and the Company regarding the services.

42. Changes to Terms

We may update or modify these Terms at any time. Updated Terms will be effective upon posting on our website, booking platform, or otherwise making them available to clients, unless a later date is stated.

Your continued booking or use of our services after changes become effective constitutes your acceptance of the revised Terms.
